An international airline law recently prevented a man from his €60,000 claim against Ryanair.  Simon Betson of Glen Ghearu, Athy, Co Kildare sued Ryanair after he fell coming down the steps of Ryanair plane on the 26th of November 2013.  Under the terms of the Montreal Convention which governs the international carriage of passengers by air, an injured person in these cases must bring their case within two years.  However the papers in this case issued on the 26 November 2016 one day after the deadline.   Lawyers for the injured person claimed that the two year period started when Mr Betson became aware that he was injured.  However the trial judge said that Mr Betson was barred from bringing the claim and that a strict two year rule applied.  Mr Betson now must pay his own solicitor and the costs of Ryanair’s solicitors.
